Rental Terms

These Terms and Conditions are a binding agreement between JAX Tents & Rentals LLC (“JAX Tents & Rentals”, “we”, “us”) and the client. The quote we send you is the agreement for your specific event; if anything on your quote differs from these terms, the quote applies.

1. Deposit and cancellation

Deposit

A non-refundable deposit is required to reserve your date and begin work on your order. No items or dates are held until the deposit is received. The deposit is applied toward the total cost of your order.

Non-refundable

Once paid, the deposit cannot be refunded under any circumstances, including event cancellations, date changes, or reductions in order size. A deposit may only be applied as a credit, as set out below.

Cancellations and credits

  • Orders cancelled 14 days or more before the scheduled delivery date may receive a store credit, less a 25% non-refundable service fee.
  • Credits are valid for six (6) months from the date issued and may be applied toward a future booking.
  • Orders cancelled within 14 days of the scheduled event date are not eligible for any refund or credit.
  • Special and custom orders, including decorations, are non-refundable and cannot be cancelled once production or preparation has begun.
  • Items we rent from another vendor on your behalf are non-refundable, including their deposits, because of the 25% non-refundable service fee and the obligations we take on when booking them.

Changes to your order

Removing or reducing items may incur a 25% service fee and may change the total cost of your order. Removing items also voids any discount applied to the order.

2. Payments and balances

  • We accept card payments through our secure checkout provider (Square) and Zelle. Our listed prices include the cost of card processing; paying by Zelle removes that cost as a discount.
  • Any remaining balance must be paid by the date shown on your quote or invoice.
  • Charges that arise after your event, such as damage, loss, cleaning, unscheduled breakdown, standby or late-return fees, will be sent to you as an itemised invoice with a payment link and are due on receipt.

3. Damage waiver

  • A damage waiver of 10% of the rental items (not of delivery or setup charges) is added to every order unless you decline it on your quote.
  • The waiver covers accidental damage that happens during normal use of the rental items.
  • The waiver does not cover loss, theft, deliberate damage, misuse, damage from ignoring the severe weather policy below, or items left out in conditions they were not designed for. It also does not cover cleaning fees.
  • If you decline the waiver, you accept responsibility for the full repair or replacement cost of any item that is damaged, lost, or not returned.

4. Your responsibility for the equipment

While it is in your care

You are responsible for all rental equipment from the time it is delivered until we collect it. Please keep items secure, use them only as intended, and have them ready for collection in the condition you received them.

Damage, loss or theft

Except where the damage waiver applies, you are financially responsible for any damaged, lost or stolen items. Charges may include:

  • Repair or replacement of damaged or missing items.
  • Fees for excessive wear, broken parts or missing components.
  • Cleaning fees for items returned with food, tape, ribbon, balloon residue or other debris.
  • An additional deep-cleaning fee for items that need stain removal or extra labor beyond normal cleaning.

Late returns and extensions

Items must be ready for collection at the agreed time so other clients are not affected. Late returns incur additional fees based on the extended rental period. To extend a rental, contact us in advance for approval.

Personal injury

JAX Tents & Rentals LLC is not responsible for injuries, accidents or damage resulting from misuse of rented items. You assume all risks associated with the use of the rental equipment and agree to indemnify and hold JAX Tents & Rentals LLC harmless from any related claims.

5. Delivery and collection

Inspection

Please inspect all items at delivery and tell our crew about any problem at that time. If items are not inspected at delivery, you waive the right to dispute their condition when they are collected.

Delivery fees and timing

Delivery fees are based on location. Specific delivery times must be requested in advance. We will give you an estimated delivery window before your event.

After-hours fee

A fee of $35 per hour applies to deliveries or collections outside normal business hours.

Standby and access fees

If our crew arrives and the items are not ready for collection, no one is available to give access, or the site cannot be reached, a standby fee of $50 per 30 minutes (or part of 30 minutes) applies. If we have to make a return trip because we could not get access, an additional delivery fee will be charged.

6. Setup and breakdown

Your responsibility

Unless setup and breakdown service is on your quote, you are responsible for setting up and breaking down all rental items. Tables and chairs must be folded and stacked before collection if breakdown service was not purchased.

Unscheduled breakdown

If our team has to break down items without breakdown service having been arranged, a minimum fee of $150 applies.

Confirming details

Please confirm all setup requirements at least 7 days before delivery to avoid scheduling delays or additional labor fees.

7. Tent installation

Site visit

If you would like a site visit or measurement check before booking, a $50 site visit fee applies. It is credited toward your order if you go ahead with the booking.

Measurements

You must provide accurate measurements of the setup area. JAX Tents & Rentals LLC is not responsible for problems caused by incorrect or incomplete measurements.

Ground and property

Tent installation may cause minor lawn compression or ground disturbance. You accept responsibility for any property damage, including to underground utilities, sprinkler systems and landscaping.

Marking utilities and sprinklers

All underground lines, pipes and sprinklers must be clearly marked before installation. If they are not, JAX Tents & Rentals LLC is not liable for resulting damage.

Site preparation

The setup area must be clear of debris, obstacles and animal waste before we arrive. Additional cleaning or site preparation fees may apply if it is not ready.

8. Weather

Severe weather

In hazardous weather, including high winds, thunderstorms or flooding, everyone must leave tents and outdoor structures immediately. We may remove or take down equipment to prevent injury or damage.

Unsafe conditions

If weather or site conditions make installation unsafe, JAX Tents & Rentals LLC may delay or cancel setup at its discretion. In that case the deposit remains non-refundable, but you may receive a credit toward a future event within six (6) months.

9. Circumstances beyond our control

JAX Tents & Rentals LLC is not liable for delays or cancellations caused by circumstances beyond its control, including natural disasters, power outages, transportation failures, strikes, pandemics or government restrictions. In such cases we may reschedule or cancel the order with notice. Deposits remain non-refundable but may be applied as a credit toward a future reservation.

10. Acceptance

By ticking the box to accept these terms, paying a deposit, or placing an order, you confirm that you have read, understood and agree to these Terms and Conditions.
